Welcome to Feather and Flora (https://featherandflora.au). These Terms and Conditions govern your use of our website and the purchase of any artwork, photography, prints, or products from us.

By browsing our website or placing an order, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our website or purchase our products.

1. Intellectual Property & Copyright

  • Ownership: All content on this website, including but not limited to Rosalie’s art, Beverley’s photography, text, logos, graphics, and digital images, is the intellectual property of Feather and Flora and its creators.
  • Restrictions on Physical Goods: Your purchase of a physical print or original artwork does nottransfer copyright or reproduction rights to you. You may not copy, scan, reproduce, resell, or commercially exploit any physical artwork or photography purchased from us without our explicit, written consent.

1A. Digital Downloads & License Terms

If you purchase or download any digital files, digital artwork, or photographic downloads (collectively, “Digital Downloads”) from our website, the following terms apply:

  • Personal Use License: Unless explicitly stated otherwise in writing, your purchase grants you a single, non-exclusive, non-transferable, revocable license to use the Digital Downloads for personal, non-commercial use only (e.g., printing a single copy for your home or setting it as a device background).
  • Commercial Restrictions: You must not resell, redistribute, sub-license, share, or give away the digital files to any third party. You are strictly prohibited from uploading our digital files to print-on-demand websites or using them for any commercial branding, advertising, or merchandise.
  • Delivery of Digital Goods: Digital Downloads are delivered automatically via a download link sent to your provided email address once payment is successfully processed.
  • No Refunds on Digital Goods: Due to the immediate, digital nature of these products, all sales of Digital Downloads are final. In accordance with the Australian Consumer Law, we do not offer refunds or exchanges for a change of mind once the file link has been generated or downloaded. If a file is corrupted or defective, please contact us immediately for a replacement link.

2. Product Descriptions & Pricing

  • Accuracy: We take all reasonable care to ensure that product descriptions, dimensions, and colors are displayed accurately on our website. However, because computer screens vary, we cannot guarantee that your monitor’s display of any color will precisely match the physical product.
  • Pricing: All prices listed on our website are in Australian Dollars (AUD). Prices are subject to change without notice.
  • GST: Unless stated otherwise, prices are inclusive of Goods and Services Tax (GST) where applicable.

3. Orders and Payment

  • Contract: An order placed by you is an offer to purchase. We reserve the right to accept or reject your order for any reason, including product unavailability, errors in pricing, or issues identified with payment authorization.
  • Payment Methods: Payments must be made in full via bank transfer to our nominated bank account before any physical artwork or digital files are dispatched or delivered.

4. Shipping and Delivery

  • Dispatch: We will make every effort to dispatch your order within the estimated timeframes specified during checkout. Original art and custom photography prints may require additional handling time.
  • Delivery Risks: Delivery is handled by third-party postal and courier services. While we pack all items securely, we are not liable for delivery delays outside of our reasonable control.
  • Incorrect Address: It is your responsibility to provide the correct shipping address. If an item is returned to us due to an incorrect address provided by you, you will be responsible for the redelivery fees.

5. Australian Consumer Law (ACL) Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

  • You are entitled to a replacement or refund for a major failure of a product, and compensation for any other reasonably foreseeable loss or damage.
  • You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

6. Refunds, Returns, and Damage in Transit

  • Damage in Transit: If your artwork or photography print arrives damaged, please take clear photos of the damaged packaging and product immediately and contact us via our contact page within 7 days of delivery so we can arrange a replacement or refund under the ACL.
  • Change of Mind: Please choose your items carefully. Because prints are often custom-made to order, and original artworks are unique, we do not offer refunds or exchanges for a simple “change of mind” unless required by law.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Feather and Flora will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our website or the purchase of our products. Our liability to you for any proven loss or damage is strictly limited to the total amount paid by you for the specific product in question.

8. Website Availability and Moderation

  • Availability: We strive to keep our website secure and operational, but we do not guarantee uninterrupted or error-free access.
  • User Comments: If you leave comments on our posts, you agree not to post any content that is unlawful, defamatory, offensive, or infringes on third-party rights. We reserve the right to remove any comments or user-generated content at our absolute discretion.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
